1) Eligibility
You must be at least 13. If you are under the age of majority in your region you need parental or guardian consent. If we learn a user is under 13 we may limit or terminate access consistent with applicable law.
2) Account, Authentication, Security
We use Firebase Authentication for sign in. You are responsible for your credentials and all activity on your account. We may suspend or terminate accounts for violations or risk. Firebase processes customer data under its data processing and security terms.
3) License
We grant a limited, revocable, non exclusive, non transferable license to use the App for personal and lawful purposes. No resale. No scraping. No reverse engineering except where permitted by law.
4) Service Components and Third Parties
Firebase. We use Firebase for authentication, data storage, analytics, crash reports, remote config, app verification, and server functions. We configure Firebase Security Rules to restrict access to authorized users.
OpenAI. Some features send your inputs to OpenAI APIs to generate outputs. OpenAI usage policies apply. OpenAI states API data is not used to train OpenAI models unless you opt in. We do not opt in.
5) Subscriptions, Trials, Billing, Refunds
Paid features may be subscriptions, consumables, or lifetime unlocks. Prices and terms are shown at purchase. Apple and Google process payments. Refunds follow Apple Media Services terms or Google Play policies and applicable law.
6) Content, AI Outputs, and Your Data
Your inputs. You own your inputs. You grant us and our providers a worldwide, non exclusive, royalty free license to process them to operate and secure the Service, provide features, and comply with law.
AI outputs. Outputs may be inaccurate or incomplete. They are for information and entertainment. Do not rely on them for health, legal, financial, or safety critical decisions.
No professional advice. The Service is not medical, psychological, legal, or financial advice. Seek a qualified professional.
7) Privacy
Our Privacy Policy explains what we collect, why, how we share, retention, and your choices. In Canada, PIPEDA applies to private sector commercial activity. In British Columbia, PIPA applies to private organizations. EU and UK users receive GDPR rights.
8) Acceptable Use
- Do not break the law or violate intellectual property rights.
- Do not harass, abuse, or discriminate.
- Do not attempt to disable security or probe systems.
- Do not bypass purchase flows.
- Follow OpenAI usage policies when using AI features.
9) Intellectual Property
We and our licensors own the Service, including software, designs, databases, and trademarks. You may not copy, modify, host, or create derivative works except as these Terms allow. You own your inputs and, to the extent allowed by law and third party terms, you may use your outputs.
10) Feedback
If you submit feedback or suggestions we may use them without restriction or payment.
11) Safety and Moderation
We may filter, block, or remove content that violates these Terms or law. We may restrict features to mitigate risk including for suspected underage use or unsafe prompts.
12) Beta and Experimental Features
Beta features may change, be suspended, or be removed. They may be unreliable or incomplete. Use at your own risk.
13) Availability and Changes
Features can change. We may suspend or end parts of the Service. We will post material changes to these Terms with a new effective date.
14) Termination
You may stop using the Service at any time. We may suspend or terminate access for breach, risk, or misuse. On termination your license ends. Sections that should survive will survive.
15) Disclaimers
The Service is provided “as is” and “as available”. No warranties of any kind, express or implied. That includes merchantability, fitness for a purpose, quiet enjoyment, and non infringement. No warranty of uninterrupted or error free operation, accuracy of outputs, or compatibility.
16) Limitation of Liability
To the maximum extent permitted by law:
- No indirect, incidental, special, exemplary, punitive, or consequential damages.
- Our total liability for all claims is capped at the amounts you paid us in the 12 months before the claim or 50 CAD if no fees were paid.
Some regions do not allow certain limits. Those limits apply only where lawful.
17) Indemnification
You will defend and indemnify us and our affiliates from third party claims, damages, and costs arising from your content, your use, or your breach, except to the extent of our willful misconduct or statutory fault.
18) App Store Terms
Your purchases are also governed by Apple Media Services terms and Google Play terms. In conflicts, store terms may control for billing and refunds.
19) Compliance, Export, and Sanctions
You must comply with applicable laws, export controls, and sanctions. You represent you are not on a restricted list and will not use the Service in prohibited regions.
20) Data Security
We apply administrative, technical, and physical safeguards. For Firebase hosted data we maintain Firebase Security Rules that restrict data to authorized users and enforce validations.
21) Regional Terms
Canada. PIPEDA fair information principles apply to private sector activity. In British Columbia, PIPA governs private organizations. You may contact the Office of the Information and Privacy Commissioner for BC.
EU and UK. We act as controller for Service data. Providers like Firebase and OpenAI act as processors under controller instructions, consistent with GDPR controller and processor roles.
Minors. Where local law imposes higher age thresholds or duties we follow those rules.
22) Dispute Resolution
Good faith negotiation for 30 days before formal action. Binding arbitration administered by the ADR Institute of Canada under its Arbitration Rules. Seat Vancouver, British Columbia. No class or representative actions where lawful. If unenforceable in your region disputes proceed in the courts of British Columbia.
23) Notices
We may provide notices by in app message, email, or posting. You consent to electronic communications.
24) Assignment
You may not assign these Terms. We may assign them to an affiliate, acquirer, or as part of a transaction.
25) Entire Agreement and Order of Precedence
These Terms, the Privacy Policy, store terms, and any feature specific terms form the entire agreement. Order of precedence: mandatory law, store billing terms, feature specific terms, these Terms, then the Privacy Policy.
26) Severability
If any provision is unenforceable the rest remains in effect.
